Key points
- Staying in Azerbaijan without a valid visa or permit, or without address registration, is fined AZN 300 to 400, with or without expulsion (Administrative Offences Code, Article 575).
- Breaking the purpose of your visa, for example working on a tourist e visa, can also bring a 5 year entry ban.
- An unpaid migration fine can block your exit and your next entry, and is a reason to refuse or cancel a permit; the entry ban lifts once the fine is paid.
- To stay longer legally, apply for a TRC at least 30 days before your stay ends, or for a short stay extension at least 3 days before, on the grounds the law allows.
- Pending applications that were accepted keep your stay legal, so file early.

What counts as an overstay in Azerbaijan?
You overstay when you are still in Azerbaijan after the day your right to stay ends. That day depends on how you came:
- ASAN Visa (e visa): 30 days from entry, single entry.
- Visa free: at most 90 days, or the shorter period for your country. Some nationalities, for example Russia, have 90 days per calendar year.
- Embassy visa: the stay shown on the visa.
- TRC or permanent residence: the end date on the card.
Check your own limit with the free visa checker or in visa free countries for Azerbaijan.
Overstay and migration fines
The fine amount within the range is decided by the authorities. Expulsion comes with a ban on entering again.
| Offence | Article | Penalty |
|---|---|---|
| Living without documents that give the right to stay, or with invalid documents | 575.1.1, 575.1.2 | AZN 300 to 400, with or without expulsion |
| Not leaving after the stay or residence period ends | 575.1.6 | AZN 300 to 400, with or without expulsion |
| Living without address registration, or not registering after a move | 575.1 | AZN 300 to 400, with or without expulsion |
| Breaking the declared purpose of the visa | 575.1.3 | Fine, plus a possible 5 year entry ban (Migration Code 16.1.6) |

Late filing: when you lose the permit itself
Some deadlines do not bring a fine first; they end the permit. Know these:
- TRC fee not paid within 30 days after processing ends: the permit is cancelled.
- TRC extension not filed: without an extension you must leave when the card ends. Apply at least 30 days before. See TRC renewal.
- More than 90 days abroad in any 180 days on a TRC: the permit can be cancelled (highly skilled migrants are exempt).
- Owner removes you from the address: bring a document for a new home within 10 working days, or the permit is cancelled.
- Work permit job ends early: leave within 10 working days unless you have another ground.
- Permanent residence fee not paid within 30 days: the permit is cancelled.
What happens at the border?
Unpaid administrative penalties are one of the reasons a person can be stopped from leaving Azerbaijan (Migration Code, Article 17), together with criminal cases and unpaid court or tax debts. So pay any fine before your flight.
An unpaid migration fine is also a reason to refuse you entry next time (Article 16.1.8). The ban lifts as soon as the fine is paid. Giving false information about yourself or your purpose, or breaking the purpose on an earlier stay, can bring a 5 year entry ban.
Border guards and the State Migration Service have the final word. Keep your passport stamps and registration papers, and do not rely on anyone's verbal promise.
Common ways people overstay by mistake
- Mixing up the e visa's validity with the stay. The ASAN Visa is valid for 90 days, but you can stay only 30 days after entry.
- Forgetting a calendar year limit. Citizens of Russia, for example, have 90 days per calendar year, not per trip.
- Filing for a TRC on day 29 of an e visa. Apply at least 30 days before your stay ends, so on a 30 day e visa file in your first days here.
- Assuming a refused application still protects you. Once you are refused, you must leave on time.
- Missing the TRC fee window, so an approved permit is cancelled and you are left without a document.
- Starting work on a tourist e visa or a family permit. This breaks the declared purpose and can bring a fine and a 5 year ban.
Your visa purpose should match what you do here. The State Migration Service advises people who plan a TRC to enter on a visa that fits their purpose: work, study or family.
How to stay longer legally
- 1
Apply for a TRC in time
If you have a legal ground (study, work, business, investment, family), apply for a temporary residence permit at least 30 days before your stay ends. An accepted application keeps you legal while you wait.
- 2
Or ask for a stay extension
A temporary stay extension of up to 60 days is possible only on set grounds: urgent medical treatment, a relative's illness or death, unfinished official work, a transit emergency, a family member's extension, or highly skilled migrants. File at least 3 days before your stay ends; the decision comes within 3 working days.
- 3
If refused, leave on time
If an extension is refused, leave before your stay ends, or within 48 hours if the stay already ran out while you waited.
- 4
Register your address
Every stay of more than 15 days needs address registration within 15 days of arrival.
A stay extension is not available for study. Students need a TRC on the study ground.
If you have already overstayed
